This Privacy Policy applies to the following tools, products and services operated by Holmusk (“Tools, Products and Services”):


  • Websites, including http://fooddx.com and the mobile-optimised versions of these websites (“Websites”).
  • Mobile applications (“Apps”) on the iPhone, the iPad, and mobile devices operating with the Android OS and other operating systems.

All other tools, products, services, websites and/or applications which reference this Privacy Policy in a link or otherwise.
In connection with our Tools, Products and Services, some of the information you provide may be personal information ("Personal Information"). Depending on the Tools, Products or Services, some of the Personal Information you provide may be personal health information (also "Personal Information"). Also, some information we collect through such Tools, Products and Services may be non-personal information (“Non-Personal Information”). You are responsible for ensuring the accuracy of the Personal Information you provide to Holmusk. Inaccurate information may affect your use of our Websites, Apps and other Tools, Products and Services.

This Privacy Policy applies to all Personal Information and Non-Personal Information that you provide to us, or that we may collect about you. Please do not provide any such information to us if you do not accept this Privacy Policy. Should you notify us that you do not accept this Privacy Policy, please note that we may only be able to provide you with limited access to our Websites, Apps, Tools, Products and Services.

2. Non-Personal Information

We may collect Non-Personal Information, i.e. information that cannot identify you or any particular person, whether on its own or with other information that Holmusk has or is likely to have access to, through the use of cookies, web beacons, and similar technology. Cookies are pieces of information that a Website transfers to a user's hard drive for record-keeping purposes. Web beacons are transparent pixel images that are used in collecting information about Website usage, e-mail response and tracking.

We may also use and disclose Non-Personal Information in the same manner as we use Personal Information as described below and in connection with our business (e.g., to our third party contractors, agents and representatives who may help us utilize cookies and web beacons, and store/handle Non-Personal Information).

Third-Party Advertisers

A designated service provider, or third-party advertisers or their advertising servers may also place or recognize unique cookies on your device or use similar electronic tools in order to display advertisements that you see on our Website. Information about your visits to, and activity on, our Website, IP address, as well as the number of times you have viewed an advertisement, may be collected and used to display on your device screen customized advertisements that may be of particular interest to you.

Holmusk's designated service provider may assist Holmusk with advertisement display functions for our Websites. For more information about such provider's handling of Non-Personal Information and use practices, including the use of cookies, as well as its instructions on how to "opt out" of having your Website usage information collected or used by such provider, please contact us via the contact information set out below. When you opt out via this method, you officially opt out of such provider's advertisement display programs for your device's particular Web browser. You need to opt out for each browser, on each device you use to surf the Web. Thus, if you use multiple browsers (e.g., AOL, Netscape, Internet Explorer, Firefox, etc.), you should repeat this procedure with each one. Some advertisers use companies other than Holmusk to serve their advertisement and to monitor users' responses to advertisement, and these companies ("Ad Servers") may also collect Non-Personal Information through the use of cookies or web beacons. In certain situations, information collection may be facilitated by momentarily directing your browser to the Website of an Ad Server or other third party acting on behalf of the sponsor or advertiser before re-directing your browser to its selected destination. We do not control third party's use of cookies or web beacons, or how they manage the Non-Personal Information they collect. You should not provide Personal Information to such sponsors, advertisers and Ad Servers without your consent. Certain Ad Servers allow you to prevent such third parties from collecting information through the use of cookies. In order to do so, you must opt out of such information collection with each individual site. Currently, you can opt-out of cookies for several Ad Servers by visiting the Network Advertising Initiative gateway opt-out site.

Information from Videos

We may collect Non-Personal Information about your interactions with video content (if any) on our Website, such as the type of content viewed and information about your interactions with email messages (e.g., links clicked on and whether the messages were opened or forwarded).


Information on Web pages and Links

We may collect Non-Personal Information on Web pages and advertisements you view from the Website and links within the Website.

URL, Browser Type, Operating Systems and IP Address

Like many other Websites, we may collect Non-Personal Information about our users' utilization, activity and navigation of our Website, Websites of selected sponsors and advertisers, your browser type, IP protocol and operating system.

Use of Non-Personal Information

However, if you do not provide us your Personal Information, we may not be able to provide you with access to our Tools, Products and Services or use your Personal Information for the purposes set forth below.

Personal Information is any information about you or any individual who can be identified from that data or from that data and other information to which Holmusk has or is likely to have access. Personal Information includes, but is not limited to:

  • Identification data (for example, first and last name, email address, home, postal or other physical address, e-mail address, mobile phone number, telephone number, other contact information, title, birth date, gender, personal interests, other information needed to provide a product and/or service you requested)
  • Electronic identification data (for example, IP addresses, cookies phone information, country information and network information)
  • Payment related information
  • Solutions, products and/or services ordered and delivered
  • Your user profile including your username and password
  • Correspondence between you and Holmusk

We may also use Personal Information that is considered “sensitive” under applicable law, which may include, but is not limited to, Personal Information relating to your physical or mental health or condition, and religious beliefs. We will require your express consent to collect such “sensitive” Personal Information.

Please understand that should you provide insufficient or inaccurate Personal Information, or decline to provide obligatory Personal Information that we may request for, we may not be able to process your requirements and/or requests and ultimately, will be unable to provide you with access to our Tools, Products and Services.


Methods of Collecting Personal Information

Registration Information

From time to time, you might share Personal Information with us through newsletters, trade shows, conferences, tools, products and/or other services provided by us (and as part of the foregoing).

Interactive Tools

We may offer you interactive content, through our Websites, Apps, Tools, Products and Services. In connection with such items, we may collect information, including Personal Information, which you voluntarily share with us. Some of the tools (like certain quizzes) do not retain your Personal Information, while others (like tools offered through Apps) may store your Personal Information.

In connection with such items, we may collect information, including Personal Information, which you voluntarily share with us. For general market research surveys, studies or questionnaires we will not knowingly accept responses from minors (i.e. persons under the age of 18 years).

Some market research surveys, studies and questionnaires may provide remuneration (payment of some kind) to participants such as a gift card for your time. We will notify you upon participation in a survey if it is paid. We are responsible for the surveys which we may introduce to you through our Tools, Products and Services. Holmusk is not responsible for unauthorized surveys, studies, and questionnaires that are conducted on third-party websites. You may be directed by link, banner ad or otherwise from our Websites to visit an advertiser's website that may introduce you to surveys or questionnaires. Holmusk is not affiliated with, nor does it endorse, recommend or guarantee any part of, any services or offerings on such websites directed from Holmusk's Websites These surveys are not subject to Holmusk's Privacy Policy and are not related to Holmusk.

Purposes of Collection, Use and Disclosure of Personal Information

Except as described in this Privacy Policy, Holmusk will not collect, use or disclose any Personal Information without your consent or authorization. This limitation, however, does not apply to information that you voluntarily share publicly, information that is otherwise publicly available or information that Holmusk is required to collect or disclose under any applicable laws or regulations.

By using our Tools, Products and Services, visiting our Websites, downloading our Apps and sharing your Personal Information with us, you agree that Holmusk may collect or use your Personal Information for the purpose(s) notified to you at the point of such collection or use, and for any or all of the following purposes (“Purposes”):


  • Performing obligations in the course of or in connection with our provision of the Tools, Products and Services requested or agreed by you (e.g., newsletters, reports, results, notifications requested or agreed by you);
  • Verifying your identity;
  • Responding to, handling, and processing queries, requests, applications, complaints and feedback from you relating to the Tools, Products and Services provided by Holmusk;
  • Processing payment or credit transactions on Tools, Products and Services requested by you;
  • Sending you marketing information about our Tools, Products and Services including notifying you of our marketing events, initiatives, promotions, lucky draws, membership and rewards schemes and other promotions, and information that will enable you to participate in features and offers such as market research surveys, studies, questionnaires, polls, sweepstakes, and user forums;
  • Complying with any applicable laws, regulations, codes of practice, guidelines, or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority including compliance with any search warrant, subpoena or court order, or as is reasonably necessary or appropriate to protect the rights, property or safety of Holmusk’s related and associated companies and associates (whether locally or globally), our users, our employees, copyright owners, third-parties or the public;

  • Help us design and improve our Website, Apps, and other Tools, Products and Services to better suit your needs and interests;
  • Help us diagnose problems with our tools, products and services, and to maintain and administer our Website, Apps and properties properly;
  • Enforce Holmusk's policies and procedures, or enforce any other agreement we have with you;
  • Comply with your instructions, authorization or request;
  • Address emergencies or acts of God;
  • As part of a substantial corporate transaction, such as a sale, a merger, consolidation, or asset sale;

We may combine your Personal Information with other information. By using our Tools, Products and Services, visiting our Websites, downloading our Apps and sharing your Personal Information with us, you agree that Holmusk may disclose your Personal Information where such disclosure is required for performing obligations in the course of or in connection with our provision of the products or services requested by you, to the following parties:

  • Holmusk’s related and associated companies and affiliated entities;
  • Holmusk’s representatives, personnel, agents, consultants, contractors and vendors and other service providers who perform functions for or on our behalf;
  • Holmusk’s strategic partners and third parties;
  • Holmusk’s assignees or potential assignees and successors-in-title (if any);
  • Any person during or in connection with any merger, sale of company assets, consolidation or restructuring, financing or acquisition of all or a portion of our business by or into another company (if any);
  • Marketing research companies (if any);
  • Advertisers (if any);
  • Your agents and advisors (including but not limited to professional advisers) and any other person notified and authorised by you; and/or

The Purposes listed above may continue to apply even in situations where your relationship with us (for example, pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).


Accuracy of Personal Information

We work to ensure that Personal Information is accurate, complete and reliable for its intended use. Where the Personal Information is provided directly by you, Holmusk will presume that such Personal Information is accurate, complete and reliable for the purposes for which it was collected. You are responsible for ensuring the accuracy of the Personal Information you provide to Holmusk. Inaccurate information may affect the information you collect when using our Tools, Products and Services. Holmusk may from time to time request that you update the Personal Information submitted to us. Apart from such requests, you may, access and correct Personal Information that is in the possession or under the control of Holmusk at any time and as set out in this Privacy Policy. 

Information Contained in Correspondence

This Privacy Policy does not apply to any content, business information, ideas, concepts or inventions, other than Personal Information, that you send to us in any correspondence (including by mail or email). We retain all such information contained in your correspondence. If you want to keep any content, business information, ideas, concepts or inventions private or proprietary, do not send them in any correspondence to Holmusk.

Withdrawing Consent

The consent that you provide for the collection, use and disclosure of your Personal Information will remain valid until such time it is being withdrawn by you in writing. You may withdraw consent and request us to stop using and/or disclosing your Personal Information for any or all of the purposes listed above at any time by submitting your request in writing or via email to us via the contact information provided below.

Upon receipt of your written request to withdraw your consent, we may require reasonable time to process your request and for us to notify you of the consequences of us acceding to the same, including any legal consequences which may affect your rights and liabilities to us. In general, we shall seek to process your request within ten (10) business days of receiving it.

Whilst we respect your decision to withdraw your consent, please note that depending on the nature and scope of your request, we may not be in a position to continue providing you with access to our Website, Apps, Tools, Products or Services and we shall, in such circumstances, notify you of the same before completing the processing of your request. Should you decide to cancel your withdrawal of consent, please inform us in writing or via email via the contact information provided below.
Please note that withdrawing consent does not affect our right to continue to collect, use and disclose Personal Information where such collection, use and disclosure without consent is permitted or required under applicable laws.

Retention of Personal Information

Holmusk will retain your Personal Information for as long as it is necessary to fulfil the purpose for which it was collected, or as required or permitted under the applicable laws.

We will cease to retain your Personal Information, or remove the means by which the Personal Information can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the personal data was collected, and is no longer necessary for legal or business purposes. Records which may contain Personal Information are retained and destroyed by Holmusk in accordance with the company's Record Retention Policy (section 7 of Annexure 'A').

3. Anonymised Data

From time to time, we may collect Personal Information from you or others on your behalf under this Privacy Policy, and convert such Personal Information into anonymised (i.e. de-identified) data (“Anonymised Data”). Anonymised Data will not contain Personal Information or any information that can be used to identify you or any other person, whether alone, or in combination with other information that Holmusk has or is likely to have access.

Anonymised Data may be used, stored transferred, disclosed, assigned, leased, licensed, sold and otherwise shared with and by our partners, service providers, advertisers and/or other third parties to help us in our business and operations and for purposes permitted under the law. To further protect you, Holmusk will take steps to ensure that any unauthorised attempt by such partners, service providers, advertisers and/or other third parties to cause a re-identification of Anonymised Data will be a breach of any agreement that it has entered with Holmusk.

Please note that a reasonable fee may be charged for an access request or where a copy of your information is so requested. If so, we will inform you of the fee before processing your request. No fee is payable for any request to correct your Personal Information (including any incomplete or inaccurate information).

To access, review, correct, or remove your Personal Information or part thereof, please submit a request to us via the contact information set out below. All requests must include the following information: first name, last name, and e-mail address. While we will try our best to accommodate your request, we reserve the right to reject or limit any such requests in accordance with the provisions of any applicable laws or regulations.

Unless Holmusk is satisfied on reasonable grounds that a correction should not be made, Holmusk shall correct the Personal Information as soon as practicable, and send the corrected information to every other organisation to which such information had been provided to within a year before the date the correction was made, unless that other organisation does not need the corrected personal data for any legal or business purpose.

We will respond to your request as soon as reasonably possible. Should we not be able to respond to your request within twenty-one (21) days after receiving your request, we will inform you in writing of the time by which we will be able to respond to your request. If we are unable to accede to any request for access to or to correct any of your information, we shall generally inform you of the reasons why we are unable to do so (except where we are not required to do so under any applicable law or regulations).

This Privacy Policy only relates to Holmusk's use and disclosure of your information. Holmusk is not responsible for any information you may provide while on such third-party websites. You acknowledge and agree that Holmusk will not be responsible for the content, privacy policies or practices of such third-party websites or the companies that own them. We are not liable for their use or misuse of your information. Holmusk disclaims liability for any loss, damage, and any other consequence resulting directly or indirectly from or relating to your access to any third-party website, or any error, omission, or misrepresentation on any third-party website.

9. Legal Notice and Disclaimer

Holmusk's Tools, Products and Services (which make reference or are linked to this Privacy Policy) are provided by Holmusk as a service and convenience to users. References herein to any product, process or service do not constitute or imply endorsement, recommendation or fitness for use by Holmusk, nor does it constitute a formal offer, binding obligation or agreement to provide such product, process or service under any circumstances.
While Holmusk makes every effort to present accurate and reliable information on its Website, Apps, and its other Tools, Products and Services, Holmusk does not approve or certify such information and disclaims any and all liability and responsibility for and associated with the quality, accuracy, completeness, efficacy, timeliness or correctness of such information.

Use of such information is voluntary and reliance on it should only be undertaken after an independent review of its applicability, accuracy, completeness, efficacy and timeliness with regard to a user's specific needs and uses. Holmusk (including its contractors, employees and agents) is not responsible for, and expressly disclaims any and all liability for, damages of any kind arising out of use, reference to or reliance on the information available through its tools, products, and services which this Privacy Policy is linked or referenced. Unless provided for under applicable law, Holmusk makes no approvals, recommendations, endorsements, guarantees or warranties, including, but not limited to, any expressed or implied warranties of merchantability or fitness for any particular use or purpose of any Tools, Products and Services provided by Holmusk.

10. Conditions on Use

By using any of Holmusk's Tools, Products or Services which reference or are linked to this Privacy Policy, you agree to the terms and conditions contained in this Privacy Policy, Holmusk's Terms and Conditions, and any other agreement that we might have with you concerning the use herein. If you do not agree to any of these terms, you should not use Holmusk’s Tools, Products or Services.

If you have entered into another agreement with us about the confidentiality of your information (“Secondary Agreement”), then in the event of any conflict or inconsistency between the terms contained in the Secondary Agreement and the Privacy Policy, the terms contained in the Secondary Agreement will prevail.
You agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by, construed and interpreted in accordance with the laws of Singapore, having no regard or reference to any conflicts-of-laws principles. Any dispute shall be submitted and resolved exclusively by the courts of Singapore. You hereby expressly agree to submit to the exclusive personal jurisdiction of Singapore for the purpose of resolving any dispute relating to this Privacy Policy, Holmusk’s Terms and Conditions, or Secondary Agreement.

Holmusk reserves the right to change, add or remove terms of this Privacy Policy for any reason and at any time without notice to you other than by posting revisions accessible to you and on our Website, Apps and other Tools, Products and Services. Such changes will take effect immediately upon posting on our Website, Apps and other Tools, Products and Services. You should check our Privacy Policy periodically for any changes which have been made to it.
